This course will discuss a variety of issues regarding lawyers’ ethical representation of their clients. It will explore various California Rules of Professional Conduct, their practical application, and recent opinions pertaining to those rules. It will analyze the risks of receiving a State Bar complaint and attorney discipline. Additionally, this course will explore the limitations to the California confidentiality doctrine regarding settlement discussions and how attorneys can ethically behave during settlement discussions so as to enhance their mediation outcomes.
